Dispute Resolution Procedure

1. General

By engaging Sea Spray Marine for any detailing, polishing, cleaning, maintenance, or related marine services, you agree to the terms set out in this Legal Disclaimer. This Disclaimer applies to all services provided by Sea Spray Marine, whether performed at Boat Works (Coomera), external marinas, private residences, or any other location.

2. Limitation of Liability

Sea Spray Marine will exercise all reasonable care and skill in the performance of services. However, Sea Spray Marine's total liability to any client for loss or damage arising from the provision of services is limited to the value of the services provided under the relevant booking, except to the extent that liability cannot be excluded under Australian Consumer Law.

Sea Spray Marine is not liable for:

pre-existing damage to the vessel, its fittings, surfaces, or systems that was present prior to the commencement of service;
damage resulting from the age, condition, or structural integrity of vessel surfaces or components;
reactions caused by undisclosed previous treatments, coatings, or chemicals applied to the vessel;
damage arising from the client's failure to disclose relevant information about the vessel prior to service;
loss of use of the vessel, consequential losses, or economic loss of any kind; or
force majeure events including severe weather, natural disasters, or other events beyond our reasonable control.

3. Vessel Condition Assessment

Prior to commencing any service, Sea Spray Marine will conduct a visual condition assessment of accessible vessel surfaces. This assessment documents existing damage and known defects. Clients are encouraged to be present during this assessment or to

review and acknowledge the condition report. Sea Spray Marine's liability is limited to damage arising after the commencement of service and is not responsible for pre-existing conditions.

4. Product and Chemical Use

Sea Spray Marine uses professional-grade marine detailing products appropriate to vessel surfaces. However, every vessel is unique and surface reactions may vary based on prior treatments, age, or material composition. Sea Spray Marine is not liable for any adverse reaction to products applied where:

the client failed to disclose previous treatments or coatings;
the vessel surface is degraded beyond what could reasonably be identified during a standard assessment; or
the client has specifically requested the use of a particular product contrary to our professional recommendation.

5. Results and Outcomes

While Sea Spray Marine applies the highest standards of workmanship, final results depend on factors including the age, condition, and material of the vessel, environmental conditions, and the extent of prior maintenance. Sea Spray Marine makes no guarantee of specific cosmetic outcomes beyond what is consistent with professionally delivered services.

6. Third-Party Services and Referrals

Where Sea Spray Marine refers clients to third-party service providers (including marina operators, specialist contractors, or suppliers), we accept no liability for the quality, safety,

The client warrants that they have the authority to authorise Sea Spray Marine to access and perform work on the vessel. Sea Spray Marine accepts no liability for any claims arising from unauthorised access where access was granted by the client.

Information provided on the Sea Spray Marine website (www.seaspraymarine.com.au) is for general informational purposes only. Prices, availability, and service descriptions are subject to change without notice. Sea Spray Marine does not warrant that information on the website is complete, current, or error-free.

9. Consumer Guarantees

Nothing in this Disclaimer is intended to exclude, restrict, or modify any right or guarantee that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)). Where a consumer guarantee applies, Sea Spray Marine's liability is limited to the re-supply of the service or the cost of having the service re-supplied.

10. Governing Law

This Disclaimer is governed by the laws of Queensland, Australia. Any disputes arising in connection with Sea Spray Marine's services are subject to the exclusive jurisdiction of the courts of Queensland, Australia.
